The petitioner seeks bail in connection with Patahi P.S. Case No. 23 of 2024 instituted for the offence under Sections 392 & 34 of the Indian Penal Code. Subsequently, Section 395 of the IPC was added.

The prosecution case, in brief, is that on 10.02.2024, after closing his jewellery shop at Pakpahri market, the informant was intercepted near Padumkar Chimni by three miscreants on a white Apache motorcycle. Two of them, at pistol point, snatched gold and silver ornaments, cash, mobile phones and motorcycle keys, threatened him with death, and fled from the spot.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.11.2025. Petitioner bears one criminal antecedents, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired on the basis of confessional statement of coaccused, namely, Rahul Kumar. Nothing has been recovered from the conscious possession of the petitioner. Petitioner was not even put on T.I. Parade to ascertain his complicity in the alleged occurrence. Charge sheet has already been submitted in this case.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court
