The petitioner is languishing in custody since 13.08.2014 in a complaint case in which processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 365, 342, 504 and 364 of the Indian Penal Code.

It is alleged that the complainant was abducted by the petitioner and others and taken to Umanath Temple, Barh and get the complainant married on pistol point with a girl on 07.02.2012. The complainant was released on 11.02.2012 and after the occurrence the complainant conveyed this fact to his father, who made protest to the family of the accused persons when the family members of the complainant proposed for some

It is submitted by learned counsel for the petitioner that for the occurrence of 07.02.2012 the complaint was filed on 01.05.2012 and the wife of the complainant has filed case under Section 498A of the IPC. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. It is submitted by learned counsel for the complainant that the complainant was filed with delay as there was chance of some resolution of the dispute between the parties. Considering the delayed lodging of the case when the wife of the complainant filed case under Section 498A of the IPC which is not denied by the counsel for the complainant, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Ist Class, Barh in connection with Complaint Case No. 240(C) of 2012.
