Ms.Sharda Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 02-03-2020 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kuchaikote P.S. Case No. 393 of 2019 registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioners is that the petitioners and other co-accused came with there lacerated with deadly weapons Farsa, Iron rod,Lathi and Danda and on the order of the accused-petitioner Ramautar Ram, petitioner no.1, the accused-petitioner Saheb Lal Ram, petitioner no.2 flew farsa

Patna High Court CR. MISC. No.9395 of 2020(2) dt.02-03-2020 2/2 over the head o the informant and causing head injury. Thereupon, the informant's wife Raj Kumari Devi and his son Sunil Kumar came to rescue. All the accused petitioners assaulted them by iron rod, lathi and danda.

Learned counsel for the petitioners submits that the injury report has been enclosed as Annexure-2 and the doctor found all the injuries are simple in nature. He further submits that the petitioners have got no criminal antecedent. There is land dispute between the parties.

In the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Kuchaikote P.S. Case No. 393 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
