Patna High Court Cr.Misc. No.42740 of 2014 (04) dt.10-02-2015 2/3 04/ 10-02-2015 Heard learned counsels for the petitioners and the State.

The petitioners are languishing in custody since 30.06.2014 in a case registered for the offences punishable under Section 387 of the Indian Penal Code.

It is alleged that Rs.Ten lakhs extortion was demanded through mobile from Dr. Rajesh Kumar Singh and life threatening was given. The collar of the mobile also said that he is shooter of known criminal Bablu Dubey. The name of the petitioners sprang up on the confession of co-accused Rajesh Kumar @ Amit Kumar.

It is submitted by learned counsel for the petitioners that admittedly no payment was made and except confession there is nothing on the record. The petitioners have roped in several cases only on suspicion during investigation. Considering the fact that except the confession of co-accused there is nothing against the petitioners, let the above named petitioners, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari in connection with Rajepur P.S. Case No. 45 of 2013.

No.42740 of 2014 (04) dt.10-02-2015 3/3 Since the petitioners have serious criminal antecedent, the learned court below will positively cancel the bail bonds of the petitioners, if they substantially get involved in some serious nature of the offence or default for two consecutive occasions.
