2. The petitioner has challenged the order of refusal of discharge dated 08.06.2016 passed by the learned Judicial Magistrate, 1st Class, Buxar, in Itarhi P.S. Case No.132 of 2013. Petitioner is accused in that case.

3. According to FIR, the petitioner is proprietor of Shekhar Mini Rice Mill. Allegation is that Mill through the petitioner misappropriated the rice in lieu of the paddy provided by Bihar State Food Corporation for milling purpose.

4. The learned trial-court has considered the material available on the record for refusal of the prayer of discharge.

5. During hearing of this application, learned
