JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks regular bail in connection with Baruraj P.S. Case No. 143 of 2019 registered for the offence punishable under Section 272/273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act. Allegation is that, there is a recovery of 46 liters of liquor and petitioner is named in F.I.R.

Submission of the learned counsel for the petitioner is that F.I.R. itself shows that he was not present at the spot and his name has been disclosed by the other co-accused. He is in custody since 09.12.2019, and though he is an accused in one more case, he is on bail in that case.

Heard learned A.P.P. also.

Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail
