JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Petitioner seeks bail in connection with Chandi P.S. Case No.05/2020, District - Bhojpur registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2018. There is recovery of 35 litres of country made mahua wine from the shop of the petitioner.

Submission of learned counsel for the petitioner is that the petitioner is innocent and has not committed any offence rather the said liquor was recovered from the outside of the south corner of the shop of the petitioner. Further the petitioner is in custody since 11.01.2020, having no criminal antecedent and charge sheet has been submitted, as such there is no chance of tampering with the evidence.

In view of the above facts and circumstances, let

Patna High Court CR. MISC. No.7302 of 2020(2) dt.24-02-2020 2/2 petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge-Cum-Special Judge (Excise), Bhojpur, Ara, in connection with Chandi P.S. Case No.05/2020, District - Bhojpur.
