The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other F.I.R. named co-accused are alleged to have surrounded the shop of informant and assaulted him. This petitioner is alleged to have pulled the informant from his shop and thereafter, gave iron rod blow on the head of the informant, due to which, he sustained head injury on left side and when Bheem Thakur (brother of informant) came to rescue, he was also assaulted by this petitioner and co-accused Manoj Thakur. There is case and counter case and both sides sustained injury. Petitioner has got clean antecedent.

No.8117 of 2022(2) dt.02-08-2022 2/2 However, learned A.P.P. for the State opposed the prayer for anticipatory bail and submitted that there is specific allegation against this petitioner of causing assault to informant and his brother and one of the injury, sustained by brother of informant, has been found to be grievous in nature. Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner and same is, accordingly, rejected.
