The writ petition has been filed for the following reliefs :- (i) For issuance of an appropriate , order/direction/writ in the nature of mandamus commanding and directing upon the Respondent concerned to issue sanction order for payment of due amount of family pension in favour of deceased family pension holder bearing P.P.O. S/92400 for the period 01.12.2007 to 30.04.2013 amounting of Rs.7,32,107/- (Rupees Seven Lacs Thirty Two Thousand and One Hundred Seven which could not
Patna High Court CWJC No.2690 of 2025(2) dt.04-09-2025 2/3 be paid in absence of sanctioned order from the level of Respondent No. 2 and did not communicated to the Respondent Accountant General, Bihar, Patna (Respondent No. 4) regarding which Respondent No. 4(Accountant General) vide Letter No. Pen-08 1637(22-23) dated 20.12.202 addressed to Respondent No. 2 lo send the sanctioned order so that due amount of the P.P.O. Holder may be paid but no action was taken and in the meanwhile P.P.O. holder namely Suraj Kumari died on 21.04.2023 and as such the present petitioner being a sole legal heir in capacity of sole widow daughter in-law who is entitled to get the benefits has knocked the door of this Hon'ble Court for payment of the same.
(ii) For direction upon the Respondent concerned to pay the due amount of family pension with statutory as well as up to date penal interest a s due to lethargic attitude of Respondent No. 2, valid claim has not been paid as yet.
(iii) Any other order/orders for granting any other relief/reliefs for which the petitioner is found entitled to in the facts and circumstances of the case.
3. Learned counsel for the petitioner submits that despite issuance of P.P.O No.S/92400 for the period 01.12.2007 to 30.04.2013 amounting to Rs.7,32,107/- and necessary instructions by the Office of Accountant General having been
Patna High Court CWJC No.2690 of 2025(2) dt.04-09-2025 3/3 issued to the Senior Treasury Officer, Begusarai, the said amount has not been credited in favour of the petitioner.
4. At this stage, learned counsel for the State submits that this matter can be disposed off with a direction to the concerned Senior Treasury Officer so that the amount shall be credited in her account within a period of one week.
5. On such submission, this matter is disposed off with a direction upon the Senior Treasury Officer that upon production of certified copy of this order, the amount for which the Pension Payment Order, has already been issued by the Office of Accountant General, is credited in the account of the petitioner without any inordinate delay.
