Mr. Ramashish Yadav ====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-01-2022 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Barachatti (Mohanpur) P.S. Case No. 620 of 2020 registered under Section 30(a)(d) of the Bihar Excise Act. Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Petitioner has no concern with the alleged illicit liquor.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that petitioner is owner of the alleged vehicle in which alleged illicit liquor and Mahua flowers have been recovered. Hence, this is not a fit case for anticipatory bail.

Patna High Court CR. MISC. No.18737 of 2021(2) dt.07-01-2022 2/2 Having considered the facts and circumstances of the case and the submission advanced on behalf of the State, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer of the petitioner is rejected. shailendra/- (Arvind Srivastava, J) U T
