Mr. Saroj Kumar Sharma, AC to AAG-3 ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI and HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) 12-09-2023 The present M.J.C. is filed for modification of the order dated 29.08.2017 passed in Civil Review No. 194 of 2017.
2. Order dated 29.08.2017 passed in Civil Review No. 194 of 2017 read as under:- "Apart from the fact that the application filed is for review of an order passed on 7.11.2003 in LPA No. 1002 of 2003 and there is unexplained inordinate delay of more than 13 years in filing of this application, we find that the appeal was dismissed after passing a speaking order and the grounds raised in this application are not such on the basis of which review can be permitted.
Taking note of all these circumstances, we see no reason to review the order. The review application is dismissed."
Patna High Court MJC No.1093 of 2018(3) dt.12-09-2023 2/2
3. No ground has been made out so as to modify the order dated 29.08.2017 passed in Civil Review No. 194 of 2017. Firstly, there is enormous delay of more than one decade in filing Civil Review No. 194 of 2017 to recall the order dated 07.11.2003 passed in L.P.A. No. 1002 of 2003. Their dates and events suffice to reject the present M.J.C. No. 1093 of 2018.
4. Accordingly, the present M.J.C. stands dismissed. (P. B. Bajanthri, J) (Arun Kumar Jha, J) shoaib/- U
