JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks bail in connection with Ujiarpur P.S. Case No. 176 of 2019, registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act. Allegation is of recovery of 3.750 litres of liquor from the house of the petitioner.
Submission of learned counsel for the petitioner is that he has falsely been implicated and he is ready to co-operate in the investigation if he is enlarged on bail. Heard learned APP also.
In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Samastipur,
Patna High Court CR. MISC. No.6776 of 2020(2) dt.05-02-2020 2/2 in connection with Ujiarpur P.S. Case No. 176 of 2019, subject to the condition that once he is released on bail he has to appear before the I.O. of the case and co-operate in the investigation, otherwise his bail bonds shall be cancelled.
