ANJANA MISHRA ORAL ORDER 16-02-2018 Heard learned counsel for the petitioner and learned A.A.G.-3 appearing on behalf of the State.
Patna High Court MJC No.241 of 2017 (7) dt.16-02-2018 2/3 A fresh supplementary show-cause has been filed in this case. In pursuance of the earlier order, the District Magistrate, Gaya is also present and has submitted that the petitioners' case has been given due consideration. The old panel of 2008 has since been exhausted as per the vacancy available at that point of time and, therefore, in the year 2014, fresh advertisements were issued in which the petitioner has also applied. So far as the petitioner's case for the appointment is concerned, the same was given due consideration and vide Annexure-A, to the show-cause filed by the D.M, Gaya, the matter was disposed of and the case was rejected.
Such consideration was, in fact, given in the light of the Supreme Court direction and, thereafter, the panel has lost its force. New applications have been called for which is under process.
In view of the aforementioned submissions made in the show-cause filed on 13.02.2018, this Court is satisfied that no case of Contempt of Courts Act is made out.
The application thus stands disposed of with liberty to the petitioner to pursue his claim made in 2014
