The petitioner seeks bail in a case instituted under section 379 IPC.
It has been submitted that the petitioner is in custody since 31.08.2014 and there is no criminal antecedent against him. It has further been submitted that on the confessional statement of one Manoj Mandal the stolen motor cycle was recovered from the bamboo clump and not from the possession of the petitioner. The aforesaid Manoj Mandal has been granted bail by the learned ADJ, Katihar.
Considering the facts and circumstances of the case, the petitioner abovenamed is directed to be released on bail on
Patna High Court Cr.Misc. No.41922 of 2014 (3) dt.21-01-2015 2 / 2 furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Sri Sanjay Priya, Judicial Magistrate, 1st Class, Katihar in connection with Barari P.S. Case No. 108/2014 (G.R.No.2094/2014) on condition that one of the bailors shall be his own/close family member. In the event of framing of charge the petitioner shall appear in person before the court concerned on each date. In case of default in doing so on two consecutive dates, the trial court shall cancel the bail bonds of the petitioner.
