Mr. Sakir Ahmad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 28-06-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 341/323/324 /307/ 379 / 506/34 of the Indian Penal and Section 27 of the Arms Act. Submission is that main allegation of murderous assault is against co-accused Rakesh and Madan. There is case and counter-case. One person of the petitioner-side was murdered at the hands of the prosecution. Investigation of the case is already complete. Some other co-accused have already been allowed bail by different coordinate Benches of this Court. Learned counsel for the informant opposed the prayer for bail on the ground that allegation is against all the named accused persons of commission of assault with their prior meeting of mind and their pre-design.

No.18488 of 2021(4) dt.28-06-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Taraiya P.S. Case No.148 of 2020 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
