The petitioner seeks bail in Phesar P.S. Case No. 101 of 2021, registered for the offence punishable under Sections 413, 414 of the Indian Penal Code.

As per the prosecution case, four miscreants including this petitioner were apprehended while snatching money from passengers of the train. On search, cash of Rs. 11,000/- and one mobile have been recovered from possession of this petitioner. It is submitted on behalf of the petitioner that no incriminating article has been recovered from possession of this petitioner. No test identification parade has been held till date. It is next submitted that petitioner is accused in four cases, but in all the case he was acquitted. Petitioner has been apprehended

Patna High Court CR. MISC. No.8639 of 2022(2) dt.12-04-2022 2/2 only on suspicion and no one has seen the petitioner committing the alleged offence. Petitioner is in custody since 02.12.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Phesar P.S. Case No. 101 of 2021.
