The petitioner Chandan Kumar seeks bail in Gopalpur P.S. Case No. 37 of 2014, registered for the offences punishable under Sections 376 and 511 of the Indian Penal Code. The informant made allegation that while she was going outside of her house to attend call of nature, the petitioner forcibly took her in a lonely place and made all attempts to commit rape.

Learned counsel for the petitioner submits that the petitioner is the first door neighbour of the informant and there is land dispute with regard to passage.

Considering the facts aforesaid and nature of allegation made against the petitioner and also the fact that the

No.30858 of 2014 (4) dt.12-01-2015 petitioner is in jail since 15.05.2014, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Gaytri Kumari, the learned Judicial Magistrate, Ist Class, Patna in connection with Gopalpur P.S.
