The petitioner is accused in connection with K. Hat P.S. Case No. 684 of 2019, registered under Section 302 of the Indian Penal Code.
The accusation is that Md. Sabbir Alam, father of the informant, Salma Khatoon, and his daughter-in-law, Sunno Khatoon locked her mother in the room and started to cause assault through Mugra (piece of wood), in which, her mother sustained injury and become unconscious. On raising alarm by the informant and others, both fled away from the house and her mother was rushed to the hospital for treatment, where she died. Learned counsel for the petitioner submits that

No.10090 of 2020(2) dt.03-03-2020 2/2 admittedly, the deceased, mother of the informant, was the first wife of the petitioner and she was ill and treatment was going on and she died in natural death but informant, who is daughter of the petitioner, has lodged the present case due to family dispute. Further submission is that in the postmortem report, no any external injury was found, while allegation has been made about causing assault to the deceased through piece of wood. It is further submitted that petitioner has no criminal antecedent and is in custody since 21.09.2019.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the IVth Additional Sessions Judge, Purnea, in connection with K. Hat P.S. Case No. 684 of 2019. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
