JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for grant of regular bail arises out of (Town) Nagar P.S. Case No. 48 of 2011, disclosing offences under Sections 420, 406, 467, 468, 471 and 120B of the Indian Penal Code.

It is submitted on behalf of the petitioner that the petitioner is in custody since 15.07.2015. It is alleged against him that he executed sale deed in favour of the informant with respect to a land upon consideration amount of Rs. 48,000/-, though the said land, upon enquiry was found not belonging to him. Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.46633 of 2015 (2) dt.15-10-2015 2/2 dispute is civil in nature and a Partition Suit is pending between the petitioner and other family members.

In view of the nature of accusation and the dispute, this application is allowed.

Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with (Town) Nagar P.S. Case No. 48 of 2011.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
