JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 31-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.

The petitioner apprehends his arrest in connection with Taraiya P.S. Case No. 202 of 2021, registered for the offences punishable under Sections 341, 323, 498 (A)/34 of the Indian Penal Code.

As per allegation, the petitioner is husband of the informant. Her marriage was solemnized with the petitioner seven years prior to lodging of the FIR. on 18.06.2021, the matrimonial inmates ousted her from her matrimonial house. As per allegation, the petitioner has solemnized his second marriage. The learned counsel for the petitioner has submitted that

He has submitted further that the informant was in love affair with one Ramesh Sahni and she eloped with him and in this respect Taraiya P.S. Case No. 48 of 2021 was lodged by the present petitioner. He has also submitted that when the matter became irretrievable the petitioner having no option filed a divorce case i.e. Divorce Case No. 178 of 2021.

Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Saran at Chapra in connection with Taraiya P.S. Case No. 202 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
