JUSTICE SHIVAJI PANDEY ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Complaint Case No. 441 of 2007 registered u/s 376 IPC.

Allegation in the complaint petition has been made that the petitioner had forcibly entered into the house and tried to out raise the modesty of the victim and when the local people on call arrived there, petitioner fled away. From the complaint petition it appears that the first offence had taken place on 27th May 2007 and it was repeated on 27th May 2007 and later on the case was filed on 29th May 2007.

Looking to the facts and circumstances of the case, petitioner is directed to be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.48254 of 2015 (2) dt.03-11-2015 2/2 bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Supaul in Complaint Case No.441 of 2007 subject to the conditions that the petitioner would co-operate and if the petitioner will fail to cooperate in the proceeding of the court and will remain absent for two consecutive dates without reasonable explanation, the court will pass appropriate order, including cancellation of bail bonds.
