JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-10-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.

Prayer for bail of this petitioner was earlier rejected by this court vide order dated 18.02.2020 passed in Cr. Misc. No. 66496/2019. By order dated 01.09.2021 a report from the trial court about the stage of trial was called for which reveals that case is pending at the stage of commitment. Learned counsel appearing for the petitioner submits that petitioner is in custody since 08.04.2019 and even after lapse of more than two years there is no substantive progress in the trial.

Considering the facts and circumstances of the case and the nature of accusation made against this petitioner, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.

However, since the petitioner is in custody since 08.04.2019, the trial court is directed to conclude the trial as early as possible, preferably, within nine months. (Prabhat Kumar Singh, J) BKS/- U T
