JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-08-2022 At the outset of argument learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of petitioner No.8, Tarun Kumar Shukla. Prayer is allowed.

This anticipatory bail petition is dismissed as

Patna High Court CR. MISC. No.8922 of 2022(2) dt.04-08-2022 2/3 withdrawn against petitioner No.8.

Heard learned counsel for the petitioners and the State.

Petitioners apprehend their arrest in a case registered for the offence punishable under Section 307, 324, 325, 379, 385 and some other minor Sections of the Indian Penal Code. As per the prosecution case, 12 FIR named accused persons, including these petitioners and 50 unknown persons demanded protection money from the informant and on refusal they assaulted the informant and his brother and also snatched his mobile phone and golden chain.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. There is general and omnibus allegation of assault against these petitioners. It is further submitted that the present case is counter blast of Jandaha PS case No. 72/ 2021, which was instituted by one of the accused of this case against the informant and his associates. Petitioners have got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case and clean antecedent

Patna High Court CR. MISC. No.8922 of 2022(2) dt.04-08-2022 3/3 of the petitioners, let the petitioners No. 1 to 7 and 9, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Jandaha PS case No.73/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
