====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-02-2019 Heard learned counsel for the petitioner. No one appears on behalf of the State to oppose the anticipatory bail of the petitioner.

The petitioner is seeking anticipatory bail in connection with Barsoi P.S. Case No. 248/2018 registered under Sections 363, 365, 504, 506 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is the sister's husband of the victim girl. The informant who is father-in-law of this petitioner had alleged that this petitioner had taken away his minor daughter and Nati. Referring to the statement of the victim girl as contained in Annexure-2 to the present application, learned counsel submits that on her return the victim girl has made specific statement that because she was beaten by her father and sister she had fled away and had gone to the house of her sister's husband who had

Patna High Court Cr.Misc. No.8632 of 2019(2) dt.18-02-2019 2/2 got her admitted in Madarsa and she studying there. It is submitted that the Nati of the petitioner has also returned home. In the given facts and circumstances of the case considering the statement of the victim girl under Section 164 Cr.P.C. and the relationship of the parties, in the event of his arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Barsoi P.S. Case No. 248/2018, subject to condition that petitioner shall join investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
