The petitioner seeks regular bail in a case registered under Section 302 of the Indian Penal Code and Section 27 of the Arms Act.

The informant, father of the deceased, lodged a case against unknown after recovery of the dead body of his son Kahhaiya Kunwar.

Learned counsel for the petitioner submits that there is no eye witness of the occurrence. Merely on the basis of suspicion, name of the petitioner figured in the case and the petitioner is in jail since 16.07.2014 although other accused persons, namely, Karu Kunwar, Lachhman Mishra, and Rajesh Kunwar have been enlarged on anticipatory bail vide order passed in Cr. Misc. Nos. 29170/2014, 30729/2014 & 3722/2015.
