Patna High Court CR. MISC. No.8344 of 2022(2) dt.02-09-2022 2/3 CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 02-09-2022 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard learned counsel for the petitioners as well as learned APP for the State.

The petitioners apprehend their arrest in connection with Chandramandih P.S. Case No. 103 of 2020, registered for the offences punishable under Sections 147, 148, 149, 332, 323, 353, 427, 307, 506 of the Indian Penal Code.

As per allegation, one person died in a road accident and three persons were injured. The public became furious and created road jam and also pelted stones on the police party and some police personnel were injured.

Learned counsel for the petitioners has submitted that the petitioner Nos. 1, 2 & 3 have no clean antecedent. Petitioner no. 4 has an antecedent but it was a 498(a) of the IPC and petitioner Nos. 5 and 6 have one case under Section 323, 341, 505 of the IPC and 332, 353 and 307 of the IPC. The learned counsel of the petitioner has submitted further that the persons of vicinity became furious as one person died in road accident and three persons became injured and

Patna High Court CR. MISC. No.8344 of 2022(2) dt.02-09-2022 3/3 unconscious. He has submitted further that the petitioners were not at the spot. He has also submitted that the injured person have sustained simple injuries.

Considering the above-mentioned facts and circumstances as well as the nature of allegation, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Chandramandih P.S. Case No. 103 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
