1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Obra P.S. Case no. 256 of 2021 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, the three accused persons on the point of pistol assaulted and looted the informant of his articles as mentioned in the F.I.R.

4. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against three unknown persons. The name of the petitioner transpired in the confessional statement of co-accused Brajesh Paswan. No incriminating article has been recovered from the petitioner's possession. The said Brajesh Paswan has been enlarged on bail vide order dated

Patna High Court CR. MISC. No.7781 of 2023(2) dt.29-04-2023 2/2 24.2.2023 passed in Cr. Misc. no. 57940 of 2022. The petitioner is in custody since 20.8.2022 and has not been put on T.I. Parade. Charge sheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration grant of bail to co-accused Brajesh Paswan on whose confessional statement the name of the petitioner transpired together with the petitioner having remained in custody for 8 months since 20.8.2022 and charge sheet having been submitted in the case without putting the petitioner on T.I. Parade, the petitioner is directed to be enlarged on bail in connection with Obra P.S. Case no. 256 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar, Aurangabad.
