JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 3051 of 2014, disclosing offences under Section 498-A of the Indian Penal Code and Section 4 of D.P. Act.

Allegation against the petitioner is of subjecting his wife to cruelty with respect to demand of dowry. Submission of learned counsel for the petitioner is that the petitioner is still ready to keep the complainant with himself and he offered the same in the lower court also, but in spite of sufficient opportunity given to the complainant, she did not appear. Further, he has no criminal antecedent. Heard learned A.P.P. also.

No.7839 of 2019(2) dt.13-02-2019 2/2 Having heard both sides, from the impugned order it appears that in spite of sufficient opportunity given to the complainant, she did not appear before the court below and the petitioner is still ready to keep her, in such view of the matter, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Katihar, in connection with Complaint Case No. 3051 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
