JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner seeks bail in connection with Nabi Nagar P.S. Case No. 174 of 2013 registered for the offences punishable under Sections 147/148/149/427/353/124A/121A, 302 of the Indian Penal Code, Section 17 of the C.L.A. Act, Sections 3/4/5 of the Explosive Substance Act and Sections 16/17/18/19/12/38 of the U.A.P.A. Act.

The informant came to know the name of the petitioner and several other persons on the basis of disclosure made by the villagers but the name of the villagers has not been mentioned in the First Information Report. Moreover, having more or less similar allegation, co-accused Dharminder Yadav, Sita Ram Bhuiyan @ Sitaram Buiyan and Gani Ansari @ Abdul Gani

Patna High Court Cr.Misc. No.45379 of 2015 (3) dt.05-01-2016 P2/2 Ansari @ Ghani Ansari have already been granted privilege of bail by another co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submission of the parties, the petitioner Lallu Singh is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Aurangabad in connection with Nabi Nagar P.S. Case No. 174 of 2013, subject to the conditions that one the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
