JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-11-2022 The petitioner has approached this Court against the order of interim maintenance dated 06/02/2018 passed by learned Principal Judge, Family Court, Bhojpur, Ara directing the petitioner to pay a sum of Rs. 15,000/- per month to the respondent-wife in Maintenance Case No. 138/2016 filed by the respondent under Section 125 of the Cr.P.C.

Learned counsel for the petitioner submits that petitioner is not having sufficient income to pay interim maintenance to his wife.

Admittedly, the petitioner and the respondent are husband and wife and the learned Principal Judge, Family Court, Bhojpur, Ara after taking into consideration the fact that the petitioner is a famous Bhojpuri Singer and his Album / CD is also circulated in the market, passed the order granting

Patna High Court C.Misc. No.534 of 2018(3) dt.15-11-2022 2/2 interim maintenance.

Since the petitioner has approached this Court against the order of interim maintenance, I am not inclined to interfere with the impugned order.

Accordingly, this application is rejected.

However, the learned Principal Judge, Family Court, Bhojpur, Ara is directed to dispose the Maintenance Case No. 138 / 2016 finally, in accordance with law, within a period of four months from the date of receipt / production of a copy of this order.
