JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-04-2023 The present writ petition has been filed seeking the following reliefs:- "1. (i) For issuance of writ in the nature of mandamus or any other appropriate writ commanding the petitioner he has prayed from respondents to protection of police personnel and had given delivery of possession from opposite party and remove the encroached land in respect of Khata No.415, Khesra No.1612 Rakba 3.5/12 decimals in the light of earlier decided by the court of L.R.D.C. Sheikhpura vide order dated 19.09.2013 of Land Dispute Case No.15/1314 under the Land Dispute Act 2009 (hereinafter referred to as Act) in favour of Guleshwari Devi.

(ii) For that the petitioner had purchased land form 26.10.2015 of registered sale-deed

Patna High Court CWJC No.13723 of 2016(2) dt.04-04-2023 2/2 since 6.10.2015 to name of vendor Anandi Yadav.

(iii) For that Anandi Yadav has also purchased aforesaid land by virtue of registered saledeed since 25.05.2010 to name of vendor Gulshari Devi.

(iv) For that the other person namely Rabindra Prasad, Sidheshwar Prasad son of Chandeshwar Prasad, resident of village Chordaragh tola Koinda, P.S.-Ariari, District Sheikhpura has by forcibly encroached in respect of aforesaid land threatened to the petitioner to vacate the premise."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies, as are otherwise available under the law, for redressal of the aforesaid grievances. Liberty so sought is granted.

The writ petition stands dismissed as not pressed.
