2. The petitioner seeks regular bail in connection with RunniSaidpur P.S. Case No. 585 of 2023 registered on 01.12.2023 lodged under Sections 363, 366A/34 of the I.P.C. and 8 of POCSO Act

3. As per the prosecution case, F.I.R. has been lodged against five named accused persons including the petitioner with allegation that they have kidnapped the daughter of the informant with a view to marry.

4. Counsel further submits that petitioner is innocent and has committed no offence. Counsel for the petitioner submits that name of the petitioner has been figured in this case only and only due to the reason that he is the younger brother of

Patna High Court CR. MISC. No.12880 of 2024(3) dt.18-04-2024 2/2 the accused with whom the informant daughter has eloped and entered into marriage. He further submits that petitioner is in custody since 02.12.2023 having no criminal case pending against him, in which he is on bail.

5. Learned counsel for the State opposes the prayer for bail.

6. Learned counsel for the informant vehemently opposes the prayer for bail and submits that it is true that in section 161 she had adduced the evidence against all accused persons but under Section 164, she has not narrated against the present petitioner.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 6th, Sitamarhi in connection with RunniSaidpur P.S. Case No. 585 of 2023, subject to the conditions laid down under Section 437

(3) of the Cr.P.C.
