JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Hajipur Town P.S. Case No. 624 of 2018, registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Allegation as per FIR is that the informant has received an information that some miscreants shot fire at his son and he received injuries and he was taken to hospital where he was declared died. Petitioner is not named in the FIR and later on his name transpired during investigation.

Submission of learned counsel for the petitioner is that except that he is a friend of Chandan Singh, who has enmity of the deceased, there is absolutely nothing against the petitioner and he has falsely been implicated in this case and he is ready to abide by any condition that may be imposed on him.

Patna High Court CR. MISC. No.7684 of 2019(5) dt.29-04-2019 2/2 Heard learned APP and learned counsel for the informant, who also could not controvert the above fact. Having heard both sides and in the facts and circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Town P.S.Case No. 624 of 2018, G.R.No. 4710 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
