2. The petitioner apprehends his arrest in connection with Halai P.S. Case No. 55 of 2025 dated 12.04.2025 registered for the offences punishable under sections 126(2), 115(2), 117(2), 109(1), 76, 303(2), 352, 351(2)(3) and 3(5) of the Bharatiya Nyaya Sanhita.

Learned counsel for the petitioner submits that the petitioner is a 20 year old young boy bearing no criminal antecedent and as per the FIR, the petitioner and co-accused Sajindra Rai allegedly inflicted iron-rod blow on the hand of the informant's husband, which resulted in injury to his hand, and the same is not a vital part of the body and on account of nonproduction of the X-ray report, the final opinion with regard to the said injury could not have been given by the concerned
Patna High Court CR. MISC. No. 8958 of 2026(2) dt.24-02-2026 2/3 medical expert. It is further submitted that the alleged occurrence did not take place in the manner described in the FIR and in fact, the prosecution party assaulted the petitioner's grandfather, which was accepted by the witnesses during the course of investigation and also discussed in the trial court's order. It is further submitted that an incident of free fight took place between both the parties on the alleged day and time of occurrence. It is lastly submitted that the mother of the petitioner had lodged Tajpur P.S. Case No. 82 of 2024 against the husband of the informant and other family members, and to put pressure upon the petitioner's family to compromise the said Tajpur P.S. Case No. 82 of 2024, the FIR of the present matter was lodged.
4. Learned APP for the State opposes the bail prayer of the petitioner and submits that there is serious and specific allegation against the petitioner, who along with the co-accused inflicted iron-rod blow on the body of the informant's husband, resulting in an injury to his hand.
5. In the facts and circumstances of this case, considering the above-stated facts and the pleas taken by the petitioner in this petition, coupled with petitioner's young age, this Court is inclined to grant the relief of anticipatory bail to the
Patna High Court CR. MISC. No. 8958 of 2026(2) dt.24-02-2026 3/3 petitioner. Accordingly, let the petitioner named-above, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with Halai P.S. Case No. 55 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
