2. The petitioner apprehends his arrest in connection with Banka P.S. Case No. 358 of 2020, instituted under Sections 147, 448, 323, 324, 307, 504 of the Indian Penal Code.

3. As per the prosecution case, 16 accused persons including the petitioner have assaulted several victims including the mother of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. All other injured persons have received simple injuries except the mother of the informant who has received one grievous injury. There is no specific allegation against the petitioner. Allegation against the petitioner is general in nature. Other similarly situated co-accused persons, namely, Sibu Yadav @ Subhash Kumar,

Yadav, Chhatu Yadav @ Pandav Kumar @ Chhotu Kumar and Chandeshwari Yadav @ Chano Yadav have been granted anticipatory bail by Co-ordinate Benches of this Court vide order dated 21.02.2022 and 18.11.2022 passed in Cr. Misc. Nos. 10413 of 2021 and 30436 of 2022 respectively. Petitioner has no criminal antecedent. Petitioner undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 358 of 2020, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
