The petitioner apprehends his arrest in Parsa Bazar P.S. Case No.427 of 2019 registered under Section 376(D)/506 and 34 the Indian Penal Code and 3 & 7 of the POCSO Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is submitted that similarly situated co-accused Deeraj Kumar @ Dheeraj Kumar has already been granted anticipatory bail vide order dated 18.09.2020 passed in Cr.Misc.No.7236 of 2020. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a

No.6077 of 2020(7) dt.02-12-2021 2/2 copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO-cum-A.D.J. 1st, Patna in connection with Parsa Bazar P.S. Case No.427 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure as also subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled.
