2. The petitioner apprehends his arrest for the offences alleged under Sections 376, 341, 323, 379, 504 and 506 of the Indian Penal Code, registered in connection with Mahila P.S.Case No. 32 of 2023.

3. As per allegation, the petitioner developed physical relation with the informant. She solemnized marriage with the petitioner in Dhaneshwar Temple. After taking her ornament and money, the petitioner dropped her near the railway hospital and when she went to the house of the petitioner, his family members misbehaved with the informant.

4. The learned counsel for the petitioner has submitted that the informant is already a married women, as such, there is no reason for the petitioner to give false allurement of marriage.

Patna High Court CR. MISC. No.11249 of 2025(6) dt.30-10-2025 2/3 He submitted further that the marriage of the informant was solemnized with Bablu Kumar, son of Ayodhya Rai, resident of Maheshi, P.S. Bibhutipur, District Samastipur. The xerox copy of the invitation card is annexed as Anexure-P/2.

5. On the other hand, the learned counsel for the informant and the learned APP for the State have opposed the prayer for anticipatory bail.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cumSpecial Court (POCSO), Samastipur in connection with Mahila P.S.Case No. 32 of 2023, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS.

7. The petitioner shall remain present physically before the learned court below on each and every date till framing of charges.
