The accusation against the petitioner is that he got issued passport in two different names.

The contention on behalf of the petitioner is that section 12

(1) Kha of the Passport Act is bailable in nature and so far as offences of Indian Penal Code are concerned, the same are not applicable in this case and moreover, petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Nawada Town P.S.
