====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners are apprehending his/their arrest in connection with Dhaka P.S. Case No. 292 of 2019 for the offence registered under Sections 341, 323, 354, 379, 308, 504

Patna High Court CR. MISC. No.18343 of 2021(2) dt.13-12-2021 2/3 and 506/34 of the Indian Penal Code.

The prosecution case in nutshell is that the accused persons including the petitioners abused and assaulted the informant. It is further alleged that petitioner no. 4 entered into the house of informant and took out Rs. 80,000/- after breaking lock.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in connection with the present case due to family dispute. It is further submitted that there is case and counter case between the parties. It is further submitted that petitioner nos. 1 & 2 are the father and mother of the informant and petitioner nos. 3 &4 are sister-in-law and own brother of the informant. It is further submitted that the petitioners have no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his/their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikrahana at Dhaka, East Champaran in connection with Dhaka P.S. Case No. 292 of 2019, subject to the conditions as laid
