1. The Writ petition is filed to direct the Respondents, to provide Bank account Number (saving and fixed deposit) of Late Haripod Bhowal (Who is father of petitioner) and to provide information pertaining in the balance amount of Late Haribod Bhoval.
2. Further to direct private respondent No. 4 (who is mother of the petitioner) to provide passbook
Patna High Court CWJC No.10522 of 2018 dt.09-07-2025 2/3 regarding Bank account number of Late Haribod Bhoval.
3. On perusal of the prayers/ relief portions made in the Writ petition, it is evident that it is purely a civil dispute between the petitioner and the respondent No. 4 for which proceedings were pending before the court of Civil Judge (Senior Division) Silighri in the Title Suit No. 60/2012. The petitioner had an alternative remedy available to obtain the information either from the bank or from the respondent No. 4. He has also an alternative relief to file an Interlocutory Application in the Title suit itself either for summoning the balance sheet or the saving account of his father or to summon the same from the private respondent. Furthermore, the petitioner is entitled to file an application under Right to Information Act before the bank. Instead of availing the above said remedies, the present Writ petition was filed, which is not maintainable in the eye of law.
4. At this juncture, the Learned counsel for the petitioner seeks permission to make an
Patna High Court CWJC No.10522 of 2018 dt.09-07-2025 3/3 appropriate application before the bank, for seeking his relief/s and prayed to dispose of the Writ petition in those terms.
5. In view of the above discussion, the Writ petition stands disposed of directing the petitioner to make appropriate representation before the Bank for obtaining the bank account details as well as the balance amount lying in the account of his father Late Haripod Bhaval.
6. With the aforesaid observations, the Writ petition stands disposed of and the said representation shall be disposed of as expeditiously as possible by the bank authorities.
