The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a)(d) of the Bihar Prohibition & Excise Act. There are recoveries of illicit liquors and one motorcycle. Two persons were apprehended from the spot who named the petitioners as their associates. It is submitted by learned counsel for the petitioners that petitioners were not apprehended from the spot. Nothing has been recovered from the conscious

Patna High Court CR. MISC. No.8045 of 2022(2) dt.12-08-2022 2/2 possession of the petitioners and except confessional statement of co-accused, no any cogent material was found against the petitioners. The seized place and motorcycle do not belong to the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 2, Gaya in connection with Gurua P.S. Case No. 305 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
