This is a petition for grant of regular bail in a case under Section 392 of the Indian Penal Code.
The First Information Report has been lodged against three unknown miscreants.
Learned counsel for the petitioner submits that the only material against the petitioner is the self-confessional statement before the police which has no evidentiary value in the eye of law. There is neither any recovery from the possession of the petitioner nor he has been put on Test Identification Parade, though the petitioner is in custody since 17.03.2012.
Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand)
Patna High Court Cr.Misc. No.42763 of 2013 (2) dt.24-12-2013 with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P. S. Case No. 167 of 2011, subject to the condition that the petitioner shall appear in the case on each and every date fixed by the court below and any absence of the petitioner shall be subject to the satisfaction of the court below on reasonable grounds.
