JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2020 Petitioner seeks regular bail in connection with Kesariya P. S. Case No. 504 of 2019 registered for the offence punishable under Sections 25(1-b)a, 26, 35 of the Arms Act. Recovery of one country made pistol with cartridges from the possession of the petitioner. Apart from that he is accused in two other cases also, both under Section 392 of IPC. Submission of the learned counsel for the petitioner is that in those cases petitioner has already been implicated only on confessional statement and in the present case, he is in custody for more than three and half months.
Heard learned A.P.P. also.
Having heard both sides, in view of the submissions, made above, and also considering the antecedent of the petitioner, I am not inclined to grant bail to the petitioner at this
Patna High Court CR. MISC. No.6360 of 2020(2) dt.04-02-2020 2/2 stage. However, once the charge has been framed in this case or petitioner remained in custody for six months, petitioner is at liberty to renew his prayer for bail.
With the above observations, this application is dismissed.
