JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State. Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite Court fee and to remove the defects as pointed out by the office when called upon to do so by the office. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468 and 34 of the Indian Penal Code.

The prosecution case is that informant, Sarfaraz Alam, gave his fardbeyan that Globle Saman Trading Services Company was opened in Machhli Bazar, Amba, Aurangabad, who used to tell that he is authorized dealer of greenbax broker house. It is further alleged that this trading company took rupees of the thousands of people and the informant, his wife

Patna High Court CR. MISC. No.18386 of 2021(2) dt.13-12-2021 2/2 and his brother invested Rs.8,50,000/- in the Company. It is further alleged that the petitioner paid the interest and after some time he stopped the payment of interest. It is submitted on behalf of the petitioner that other co-accused are getting the privilege of anticipatory bail vide order of this Court dated 19.01.2020 passed in Cr. Misc. No. 74160 if 2019. It is also further submitted that good sense prevailed between the informant and the accused persons which shows by Annexure 2. In the facts and circumstances of the case, let the petitioner, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Amba P.S. Case No. 51 of 2018, subject to the conditions as laid down under Section 438(2) of the Criminal Procedure Code.
