04-03-2015 Heard learned counsel for the petitioner and Sri Anuj Kumar Srivastava, learned Addl. Public Prosecutor. The petitioner, who is in custody in Rahui (Bhaganbigha) P.S. Case No.290 of 2012, S.Tr. No.168 of 2013 registered for the offence under Sections 328, 302/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that only on suspicion the petitioner has been made accused. He further submits that during investigation, no plausible material has been brought on record. However, on suspicion, he has been made accused, which is evident from the order of the learned Addl. Sessions Judge, Nalanda at Biharsharif, while rejecting the bail petition.

Patna High Court Cr.Misc. No.560 of 2015 (3) dt.04-03-2015 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner. However, he has not pointed out any specific accusation against the petitioner. In view of facts and circumstances, let the petitioner Anita @ Geeta Devi @ Geeta @ Anita Devi be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge 1st, Nalanda at Biharsharif in connection with S.Tr. No.168 of 2013 arising out of Rahui ( Bhaganbigha) P.S. Case No.290 of 2012 on condition that one of the bailors must be blood relation of the petitioner.
