The petitioner seeks bail in a case registered for offences punishable under Sections 304(B), 201/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that there is general and omnibus allegation against all the accused persons and petitioner is the husband of deceased. In fact the petitioner had informed his in-laws regarding the death of his wife and they had come and participated in the funeral also. A deed of gift was also executed by the father of the petitioner in favour of son of the petitioner. But, thereafter, for some reason they had lodged first information report after eight days.

Patna High Court Cr.Misc. No.42054 of 2014 (3) dt.21-01-2015 2/2 Learned counsel appearing for the State submits that the alleged deed of gift on Sada Paper is of no consequence and is merely an eye wash. That apart, nothing has come during the course of investigation to show that the wife of the petitioner died due to diarrhoea or even she was taken to a doctor rather the materials are there which show that she had died due to burn injury.

Having regard to the aforesaid facts and circumstances this Court is not inclined to grant bail to the petitioner at this stage.

Accordingly, this application is dismissed.
