JUSTICE RAKESH KUMAR ORAL ORDER 11-12-2015 Heard Sri Pankaj Kumar Sinha, learned counsel for the petitioner and Sri Tapeshwar Sharma, learned Addl. Public Prosecutor.

The petitioner, who is in custody in connection with Sono ( Charka Pathar) P.S. Case no.78 of 2014, registered for the offence under Sections 147, 148, 149, 427, 353, 379, 384 and 121A of the Indian Penal Code and Sections 16,17, 18,19,20, 21 and 22 of the U.A.P. Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case and he has been named on the basis of conversation in between the accused persons. Save and except the aforesaid allegation, there is no material against the petitioner.

Patna High Court Cr.Misc. No.52847 of 2015 (2) dt.11-12-2015 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner. He submits that the petitioner is not having clean antecedent and he is accused in similar type of cases also.

Keeping in view nature of accusation and antecedent, I am not inclined to grant bail. The petition stands dismissed. (Rakesh Kumar, J) NKS/- U
