Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Suiya P.S. Case No. 42 of 2021 (Special Excise Case No. 386 of 2021) for the offence punishable under Sections 30(a), 30(d), 32 of the Bihar Prohibition and Excise (Amendment) Act, 2018 and under Section 3 of Mahua Flower Act.

The petitioner is the owner of the commercial vehicle from which the alleged liquor has been recovered and being the owner of the commercial vehicle he is not not supposed to travel with the vehicle.

Considering the aforesaid facts, this bail

Let the petitioner, above named, in the event of his his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge-II-cum-Special Judge (Excise Act), Banka, District- Banka, in connection with Suiya P.S. Case No. 42 of 2021 (Special Excise Case No. 386 of 2021), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
