Petitioner seeks bail in a case registered for the offences punishable under Sections 147,148,149,341,323,324 and 302 of the Indian Penal Code and 27 of the Arms Act. Allegation is against 16 FIR named accused person to have committed assault and death of two person. Submission is that after investigation, the police did not send up four accused person for trial including the petitioner. Thereafter, the petitioner was summoned under Section 319 Cr.P.C. Petitioner is ready to cooperate with the trial. Other co-accused, who were not sent up for trial, were allowed anticipatory bail and regular bail respectively by different Coordinate Benches of this Court in Cr.Misc.
Patna High Court CR. MISC. No.7911 of 2019(3) dt.25-04-2019 2/2 No.35233 of 2018 and Cr.Misc.No.74238 of 2018. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Madhepur Police Station Case No.36 of 2014, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
