JUSTICE ANIL KUMAR SINHA ORAL ORDER 22-02-2023 Petitioner has renewed his prayer for regular bail in connection with Antichak P.S. Case No. 29 of 2020 registered for the offence under Section 304 (B) / 34 of the I.P.C. inasmuch as earlier bail application of the petitioner was rejected on 20.04.2022 vide Cr. Misc. No. 42097 of 2021. While rejecting the prayer for bail it was observed by this Court that the trial be expedited.

The bail application of the petitioner was rejected earlier on merit. This is a case of dowry death and the petitioner is the husband of the deceased.

Learned counsel for the petitioner submits that trial is not proceeding expeditiously despite the order of this Court to expedite the trial and the petitioner is in custody since 01.10.2020.

Patna High Court CR. MISC. No.8242 of 2023(2) dt.22-02-2023 2/2 Taking into consideration the nature of allegation, I am not inclined to grant regular bail to the petitioner at this stage.

The prayer for bail is rejected.

However, the petitioner may renew his prayer for regular bail after completion of 31⁄2 years in custody if the trial does not conclude by that time.
